Terms of Service
The agreement that governs your use of the NestVoice AI platform — covering subscriptions, acceptable use, calling compliance, liability, and your rights and responsibilities.

These Terms of Service (“Terms”) govern your access to and use of the websites, applications, APIs, and AI voice automation services (collectively, the “Services”) provided by
NextInfinity Technologies Private Limited (“NextInfinity”, “NestVoice AI”, “we”, “us”).
By creating an account, clicking “I agree”, or using the Services, you accept these Terms on behalf of yourself and the entity you represent. If you do not agree, do not use the Services.
02Definitions
- “Customer” — the organization or individual that subscribes to the Services.
- “End-User” — a person who interacts with the Customer’s AI voice agents.
- “Customer Content” — data, prompts, recordings, and transcripts processed through the Services on the Customer’s behalf.
- “Account” — the registered access credentials and workspace used to access the Services.
03Eligibility & Accounts
- You must be at least 18 years old and able to form a binding contract.
- You are responsible for maintaining the confidentiality of your credentials and for all activity under your Account.
- You must provide accurate registration information and keep it current.
- Notify us immediately at support@nestvoiceai.com of any unauthorized use.
04Subscriptions, Fees & Billing
- Fees are described in your order or the pricing page and are payable in advance unless otherwise agreed.
- Usage-based charges (e.g. per-minute or per-call) accrue as incurred and are billed in arrears.
- All fees are exclusive of applicable taxes, including GST, which you are responsible for paying.
- Subscriptions renew automatically unless cancelled before the renewal date. Except as required by law, fees are non-refundable.
- We may suspend the Services for overdue amounts after reasonable notice.
05Acceptable Use
You agree not to use the Services to:
- Violate any law, regulation, or third-party right;
- Place calls without a lawful basis or required consent of recipients;
- Send spam, fraudulent, deceptive, harassing, or unlawful communications;
- Impersonate any person or misrepresent your identity or affiliation;
- Reverse engineer, scrape, or circumvent security or usage limits;
- Transmit malware or interfere with the integrity of the Services.
06Customer Compliance Responsibilities
You are solely responsible for the lawful use of AI voice agents you configure, including:
- Complying with telemarketing and calling regulations, including India’s TRAI regulations and Do-Not-Disturb (DND) / DLT requirements, and equivalent laws (e.g. TCPA) in other jurisdictions;
- Obtaining consent from End-Users for calls, recording, and automated/AI interactions where required;
- Providing required disclosures that an End-User is interacting with an AI system;
- Maintaining your own privacy notices and lawful bases for processing End-User data.
07AI & Voice Services
The Services use automated speech and language models that generate responses probabilistically. Outputs may occasionally be inaccurate or incomplete. You are responsible for reviewing configurations, testing agents, and ensuring outputs are appropriate for your use case. The Services are tools and do not constitute legal, financial, medical, or professional advice.
08Intellectual Property
- We retain all rights in the Services, software, models, and our trademarks.
- You retain all rights in your Customer Content. You grant us a limited license to process it solely to provide the Services.
- You may not use our branding without prior written permission.
- Feedback you provide may be used by us without restriction to improve the Services.
09Confidentiality
Each party may access confidential information of the other. The receiving party will protect such information using reasonable care, use it only to perform under these Terms, and not disclose it except to personnel and advisors bound by confidentiality, or as required by law.
10Data Protection
Our processing of personal data is described in our Privacy Policy. Where we process End-User personal data on your behalf, we act as a Data Processor under a Data Processing Agreement and in line with the DPDP Act and, where applicable, GDPR.
11Third-Party Services
The Services may integrate with third-party products (e.g. telephony carriers, CRMs, payment processors). Your use of those products is governed by their terms, and we are not responsible for third-party services or their availability.
12Warranties & Disclaimers
The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that AI outputs will be accurate.
13Limitation of Liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, or data. Our aggregate liability arising out of or relating to the Services will not exceed the fees paid by you to us in the twelve (12) months preceding the event giving rise to the claim.
14Indemnification
You will indemnify and hold harmless
NextInfinity and its affiliates from claims, damages, and expenses (including reasonable legal fees) arising out of your Customer Content, your use of the Services, or your breach of these Terms or applicable law, including calling and consent regulations.
15Term & Termination
- These Terms apply for as long as you use the Services.
- Either party may terminate for material breach not cured within 30 days of notice.
- We may suspend or terminate access immediately for unlawful use or risk to the Services or others.
- On termination, your right to use the Services ceases and we will make Customer Content available for export for a limited period before deletion.
16Governing Law & Dispute Resolution
These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Subject to applicable law, the courts at Andhra Pradesh, India will have exclusive jurisdiction over disputes, and the parties may first attempt good-faith resolution and, where agreed, arbitration under the Arbitration and Conciliation Act, 1996.
17Changes to these Terms
We may modify these Terms from time to time. Material changes will be notified through the Services or by email, and the “Last updated” date will be revised. Continued use after changes take effect constitutes acceptance.
